He was restored to all his titles except the marquessate in 1663 and to the estates in 1667. He fought as a Royalist at the Battle of Dunbar in 1650 and at Worcester in 1651. Upon the Restoration he was imprisoned and sentenced to death in 1662 but was freed in 1663. He refused to subscribe to the Test Act and was sentenced to death for High Treason in 1681. He escaped from Edinburgh Castle disguised as a page holding up the train of his step-daughter, Lady Sophia Lindsay, and fled to Holland. He was attainted and stripped of all his titles and land. Returned to Scotland in 1685 as the pro-Monmouth leader of the Scottish forces but the rising turned in to a farce and he was captured and beheaded that same year
