By codicil dated 12th Mar, 1677, testator makes the following provisions: Should eld. sons, viz, James, Samuel, and John, die without issue, survivor or survivors of sd. 3 sons to inherit deceased's land; and in event of death of any of young. child, viz, Alexander, Nathaniel, and Eliza:, without issue, survivor or survivors to inherit deceased's land. Should all afsd. eld. child. die without issue, their land to pass to young. child. afsd. Should young.

In the name of God, amen. This the tenth day of february in the years of our Lord 1676, I Alexander Magruder being in health of body thanks be to god and calling me to Remembrance the Uncertaintie of the Transitory life & that all flesh must yield unto death when it pleased god to call I doe make Constitute ordaine & declare this my last Will & testament in manner & form following denouling & pronounceing by this presents all testament & testaments will and wills hereto fore by me made & declared either by word or writing & this onely to be taken my Last Will & testament & none other. And first being sorrie for my Sins from my heart most humbly desireing foregiveness for the same I give & comit my Soule unto Almighty god my Saviour & Redeemer in whome & by this merits Jesus Christ I trust & believe assuredly to be saved & to have full remission & foregiveness of all my sinnes & that my soule with my body at the day of the resurrection shall rise againe with joy & through the Merits of Jesus Christ death & passing possess & inherit the Kingdome of heaven prepared for the Elect Chosen & my body to be buried in such place where it shall please my Executors hereafter mentioned to poynt. Now for the settling my temporall estate & such Chattells & debts as it hath pleased god far above my deserts to bestow upon me. I ord'n & give & dispose the same in manner & forme following that is to say first I will that those debts & duties which I owe in Right or Conscience to any p'son or p'sons whatsoever shall well and truely payd in Convenient time after my decease by my Well beloved wife Elizabeth Magruder & James Magruder & Samuell Magruder whom I I doe leave & appoint & ordaine them my whole Executrix over my whole Estate. Item: I give & bequeath to my loving wife & her three children two thirds of my personal estate & that plantation that I now live on to my loving wife Elizabeth Magruder for her lifetime & after her decease to my son Alexander & my son Nathaniell to them & their heires forever, and if either of them dies without issue the the longest liver to have it. The said Land doth Containe by Patent & Conveyance Eight hundred Acres of land. Item: I will bequeath to my loving son James Magruder & John Magruder Nine hundred acres of land lying on the Western branch of Petuxent River held by two Pattents called Alexandria & Dumblain to them & their heirs. Item: I will bequeath to my Son Samuel Magruder five hundred acres of land lying in the Westerne Branch called Good Luck to him & his heires forever. Item: I will that my son Samuell shall assist my son James when he is minded for to goe upon his owne, that is for to say to cleare & fence & build as is done upon Samuell Plantation hafe as much. Item: I will and bequeath the third Part of my personall estate to my three sons James Samuell & John Magruder & if either of these my three sons dye without issue what doth belong to him that is deceased to be equally divided betwixt the other two & they are to have what estate belongeth to them at the age of Twenty years & to my daughter Elizabeth at the day of her marriage. I will & bequeath to my daughter Elizabeth two hundred acres of land called by the name Cragnigh lying in the Westerne branch of Petuxent River adjoining to my son Samuell's land her brother & these my sons shall not buy nor sell not above the value of four hundred pounds of tobacco without the consent of one of these my Overseers untill they are at the age of twenty five years of age of this my last Will & testament I request my Well beloved friends Mr. Nathaniell Truman, Mr. Samuell Taylor, Mr. Ninnian Beale. Alexander Magruder was born in 1610 in Perthshire Scotland. He supposedly married Margaret Braithwaite, Sarah who died in 1671 and finally Elizabeth Hawkins who is named in his will. He was probably never married to Margaret Braithwaite.
His children are:
1) James born 23 Dec 1658, died 1685;
2) Samuel born 1660 in Calvert Co, MD, died before 16 April 1711 in Prince Georges Co, MD, married Sarah Beall before 1686 in Calvert Co MD;
3) John born 1662, died 1685;
4) Alexander III born 1671 died 1746 in Prince George's Co, MD married widow Anne Hutchison in 1688 or 89 and Susannah Busey approx. 1715;
5) Nathaniel born 1674 or 75 in "Anchovie Hills", died 1738, married Susannah Blizzard before 1707 and Mary Jones before 1729;
6) Elizabeth born 1676 or 77, died after 1738, married (WRONG NJL) John Potinger after 1706.
The last three are the children of Elizabeth Hawkins. I am not sure which wife is the mother of the other three. I have read various reports but have seen no records to verify.
All of the above came from 'The Magruder History' by W.C. Barrickman, 1948 and 'Prominent Families in America with British Ancestrey' by Burke and I've read it a lot of other places that I didn't add to my notebook.
Alexander's will is in 'Index of Maryland Colonial Wills' by James Magruder.
Samuel and his wife Sarah's will abstracts are in 'Maryland Calendar of Wills'.
Samuel and Sarah had the following children:

2) Ninian born 1686, died 1751 to 1753 in Prince George's Co, MD and married by 1708 Elizabeth Brewer; Elizabeth born 1685 to 95 died 1764 and married Ninian Beal Jr. in 1703
and William Beall;
3) John born 1694 in Calvert Co, MD, died 1750, and married Susanna Smith 1 Dec 1715 at St Barnabas Church;
4) James born 1699 married Barbara Coombs;
5) Verlinda born 1698, died approx 1745,married John Beall;
6) William born 1701, died 1765, married Mary Fraser/Frazier in 1726;
7) Alexander born 1705, died 1751 married Susannah ?Lamar, a ? Wade and Ann Wade;
8) Sarah died by 1734 and married William Selby/Shelby;
9) Mary born 1692, died 1734 married George Claggett;
10) Eleanor born 1705 married Nehemiah Wade;
11) Nathaniel died by 1734 and married Susanna Blizzard.

According to my notes which I don't claim to be infallible, Alexander Magruder the immigrant had five sons-James, Samuel, John, Alexander III and Nathaniel and one daughter, Elizabeth. His son Samuel had a son named James who married Barbara Coombs and he also had a son named Alexander. Connie Riley criley@ghg.net

The Scottish Wars brought a small but important contingent of Scots to Calvert Co. The most famous of these was Ninian Beall, the comander of the Calvert Co. Rangers. Perhaps of equal importance, by reason of notable descendants, was Alexander Magruder, the progenitor of the Magruder family of Maryland. Taken prisoner by Oliver Cromwell's men at the Battle of Worcester in 1651, Alexander Magruder was exiled to the Colonies and appeared in Calvert Co. shortly thereafter. His landed estates included Alexander's Hope, in Lyon's Creek Hundred, in Calvert Co. Alexander Magruder, however, had dwelling plantation at Anchovie Hills, in the freshes of Aquasco Creek. This is located on the western side of the Patuxent River, and is no longer in Calvert Co. territory. In fact, most of the Scots seem to live settled, under the leadership of Niniam Beall, in that portion of Calvert Co. which later became seperated into Prince George's Co.

Alexander MACGRUETHER, the progenitor of the MAGRUDERS of Maryland, was the son of Alexander MACGREGOR, b. Perthshire, Scotland, 1569; d. Perthshire, Scotland, 1605; descended from Alpin, King of Scotland, 834, and Lady Margaret DRUMMOND, dau. of Campbell, First Laird, or Baron of Keathock, in Angus, Perthshire, and wid. of Sir Andrew DRUMMOND, Fourth Laird of Ballyclove. Alexander, the immigrant, was an Officer in the army of Charles II, and was captured at the Battle of Worcester, 1651; in the same year he was sent as a prisoner of war to Virginia, by way of Barbadoes, but in 1652 he ransomed himself and received a grant of 500 acres of land at "Turkey Buzzard Island," Calvert County, Maryland, near the Patuxent River; at the time of his death, in 1677, he was possessed of upwards of 4000 acres of land, known as "Craignaigh," "Dumblane,", "Good Luck", "Anchovie Hills." The first above Alexander Magruder (1610-1677) married third to Elizabeth Hawkins about 1672. They had the following children:

From other sources (which I don't know what they were as I didn't site a source) I have that James Magruder who married Barbara Coombs, was born in 1685. I also have other dates that are different than the above source.
Another source: American Clan Gregor Society, Proceedings of Twenty-Sixth Annual Gatherings, published in 1935 state: "In Liber 17, folio 211 of the Testamentary Proceedings: 'The deposition of Samuel Magruder aged 38 upon oath said this second Sept. 1698 testifies as to a note of bond for L46&' " (the L is pounds, my computer doesn't make a pound symbol)
