This is the last Will & Testament of me William Bennion of Queensferry, Flintshire made this twenty seventh day of October in the year of our Lord One thousand eight hundred & fifty six I hereby appoint Mr. Robert Wiliams of Chestor & Mr. John Lamb of Queensferry my sole Executors and in case of the death of either of them the survivor with full power to said Executors or the survivor to fully carry out my wishes as to the disposal of my Property as hereinafter expressed & in case of the death of both of my said Executors the same to be carried into effect as Law may direct. All my Property in Liverpool consisting of the Leasehold of certain premises to be held in trust by my Executors as aforesaid for the aforementioned purposes, the mortgages presently existing upon such premises or part thereof to be liquidated & paid off by my Exrs out of any moneys they may receive from my estate or from the p97 the accumulation of Rents or otherwise on my account. At my death said Executors to take charge of my property in Liverpool as also at the Queensferry they will see to the due & proper collection of the Rents of the same & after all necessary deductions place the Balance in the North & South Wales Bank for the liquidation of the Mortgages as above or for the other purposes of this my last Will as to them may appear proper keeping in view of my wishes as herein expressed or intended to be expressed, said Exrs to keep records of Receipts & expenditures they charging all proper & necessary expenses incurred by them in the discharge of their duties under this Will and all moneys entered by them in said Bank to be placed to one single account in their joint names as my Exrs.
All my Stock in trade at the Ferry including outstanding accounts & goods (unless cancelled by me) & fixtures, Household furniture & other Chattels at my Shop or Dwellinghouse to be at my death given over to my niece Emma Chamberelain who will carry on the Business as presently managed by her, said Effects to be given over to her subject to conditions to be herein recited and on her giving my Executors a Promissory Note for Two hundred & thirty pounds in consideration for the same, said Note for L230 to be wholy partially paid or cancelled as circumstances may rendor necessary and as I shall hereinafter express, Believing that my dear Son & only surviving child is in Australia & hoping that he may return to his native land a sober steady man but wishing to provide for him should he return addicted to the use of Intoxicating drinks - I sincerely desire my Executors to act towards him in a firm yet kindly manner and to carry out my desires towards him in as far as in them lies and to enable them to do so my wish is that for twelve months after his Return to his native Country he remain a Total Abstainer from all Intoxicating Drinks which I leave to the discretion of my Exrs to satisfy themselves by longer delay to prove his Sobriety before carrying out my wishes my only intention being to give reasonable grounds of assurance of his Sobriety. On their being so satisfied then my Wish is that he is installed in the Business at the Ferry and which has been conducted by my niece as aforesaid, receiving from her the Stock in trade, furniture fixtures & so forth as given over to her at my death if equal to One hudnred & thirty pounds or the sum of one hundnred & thirty pounds or the difference if any as my Executors may p98 award (taking into account the Outstanding debts at my death & given
over to my niece as part value of the L230 and which she may after using all proper means have failed in recovering) the said Sum of L130 being the Balance on the Promissory Note given by my Niece at my death to my Executors One hundred pounds having been paid by her on account thereof. And on such restitution of Stock & or payment of money as aforesaid the said Promisssory Note for L250 granted by her to be then given over to her and cancelled. Should my Son however return and my Executors be able to prove cause against his Induction to the Business as stipulated by me my said Niece to continue the management of the same and at the expircy of Two years from the date of my Sons Return & non instalment in the business that they shall fully settle her in the same permanently & unconditionally giving her over the right to all connected & as she has been temporarily or conditionally in possession of and cancelling and nullifying the Promisory Note or the Balance thereof (viz. L130) giving her over the same and which will be considered as the Legacy I in that case equeath and leave to her for her kindness to me & for carrying on the Business with a view to my Sons Benefit & which he will have failed in claiming - My Niece thereafter paying Rent to my Executors for the Shop & premises while occupied by her at the rate of Ten pounds yearly clear of all Rates & taxes they well & regularly paying the Lease Rent for the same to Admiral Dundas as such becomes due - and in this Event my Son to be allowed a payment of Ten shillings weekly which I call upon my said Exrs to see well & duly paid and if they shall at any time see it necessary to increase such weekly payment they may add to the same no however exceeding in any year the free annual receipts from all my Property. I have in this my last Will desired that my Niece Emma Chamberelain shall at my death carry on the Business at the Ferry & that she give my Exrs a Promissory Note for L230 for Value received - on this Note my Niece will pay within ------- Months after my Death One hundred pounds in Cash on account thereof the Balance (L130) to be accounted for by her or cancelled by my Exrs & given to her as circumstances may demand & as already provided for herein. I have also expressed the conditions on which I desire my Son to get posession of the business & promises & may my God forgive me if I have in this dealt harshly by him. Should my Son conform to my desires & be put in posessison of the Business & premises & recieve Value of the Balance of the Note viz. L130 from my Niece as aforesaid seeing that by such she has fully & freely given up what might have been her Living - I hereby desire that she receive from my Executors in lieu thereof the full & free Rent of that House in Liverpool being the first in being the first in Hill Court the same to be paid to her half yearly so long as available after which due consideration for such as to be made her in any subdivision of residue if any as may be apportioned and for such it is my desire that she assist my Son in carrying on his Business at the Ferry & not on any account oppose his trade. My Executors shall judge when she cannot or may not be in a position or it be not desirable that she may assist him. They keeping in view that my only reasons for desiring such being to induce a friendly feeling between them not to force my Niece to serve him if disagreeable to either of them, nor to deprive her of the rent of said House should she find it desirable to leave him. Again, should my Son return & continue sober & still not wish to take to my business at the Ferry then Emma Chamberlain to carry on the same being duly installed & receiving the Promissary Note cancelled as already provided in case of his non Instalment only in so far as regards himself that is he shall in this last presumed Case receive the full free annual rental of all my property the same to be paid to him half yearly or as he may desire. At the expiration of the several Leases of my Property the Exrs to hand over to my Son if alive the rents & moneys a
ccumulated or accruing therefrom except such proportion as they may award to my Niece Emma Chamberlain for the loss of Rent on her part & as aforesaid if my Son be dead then the same to be divided equally between Samuel Bennion Williams, Holyhead, William Jones of Shotton, my nephew & the children of John Chamberlain except Emma already provided for.
