In Directed Verdict . . . Traffic Vicitm Gets $72,500 in Court Case - A directed verdict in the Clearfield County Courts this morning awareded $72,500 to a young victim of a 1965 traffic accident and his parents. After an agreement had been privately reached by all litigants, Judge John A. Cherry directed the jury to bring in a verdict in this amohnt in favor of the plaintiffs in the suit brought by 20-year-old Reuben Wisor of Mineral Springs through his father and guardian, Cleve Wisor, and by Mr. Wisor and his wife, Catherine, against Ronald L. Carns of Clearfield and Carns Brothers Inc. The verdict awards $67,689.50 to Reuben Wisor who is permanately disabled as a result of the accident and $4,810.50 to his parents for medical and hospital expenses, damages to their car, etc. The case, the first to be tried during the May court term, was the outcome of a traffic accident on Route 322 near the American Diner, outside Philipsburg on the afternoon of Jan. 5, 1965. At the time, Reuben Wisor, the driver of the one car, and two companions were returning home from Philipsburg where they had spent a half hour and had made a stop at the Philipsburg Osceola High School. Ronald Carns, the driver of the other car, was en route to . . . (continued page 10 column 4) . . . Philipsburg after making a trip to Clearfield to pick up some items for use on a Carns Borhters Inc. construction project on which he was employed. Although he was driving his own car, both he and his father, Robert Carns, now owner of the general contracting company, testified that he was being paid by the company at the time of the accident. Yesterday the plaintiffs presented witnesses to show that Mr. Carns had been at fault in the accident and that Reuben Wisor, who was then 18 years of age had suffered permanent injuries which would prevent him from being gainfully employed. Mr. Wisor and two companions who were with him at the time of the accident - Lee and Robert Lumadue, also of Mineral Springs said they were traveling toward Clearfield from Philipsburg and were in the vicinity of the diner when they saw the Carns car approaching in the proper lane of traffic. They testified that seconds before the cars were to pass each other, Mr. Carns swerved into their lane of traffic. In order to avoid a collision Mr. Wisor pulled to the left of the center lane where the collision occurred. He told the jurors he was unable to go to the right because of the guardrail fence. All of the young men were injured and were removed by ambulance to the Philipsburg State General Hospital. Mr. Wisor was the most seriously hurt and two days after the accident was transferred to the Williamsport Hosptial. One of the physicians at the Williamsport Hospital, Dr. Robert G. Stevens, who specializes in physical medicine and rehabiliation, was on the witness stand most of yesterday afternoon, testifying to the youth's injuries and the rehabilitative measures taken to correct them. The doctor said that Mr. Wisor was in critical condition when he was admitted to the hospital. A fractured fifth vertebra in his neck had caused pressure on his spinal cord which resulted in paralysis of both arms and legs and most of his body. His bowels and bladder did not function and he had great difficulty in breathing. When traction failed to relieve the pressure on the spinal cord it was necessary to perform an operation to save the youth's life, Dr. Stevens said. The operation was successful but for between eight and 10 weeks, Mr. Wisor was totally dependent on other people, the doctor said. He lay flat on his back and because of traction was unable to move his head more than 20 degrees. After his physical condition had improved, rehabilitation was started at the hospital. The doctor said that during the weeks that followed he had to be taught to walk again and had to use his left hadn rather than his right since he will never recover fully from the paralysis of the right side. After daily treatments until April 1965, Mr. Wisor was able to walk without assistance and to abandon t
he use of a neck brace. Dr. Stevens said, however, that the bones in his neck have fused together giving him only slight forward mobility of his head. This condition, the doctor predicted will worsen as Mr. Wisor ages. He also said that in his opinion that the paralysis in the victims' right side will not improve and as he becomes older he will be subject to bladder and kidney infections. The plaintiffs in the suit were represented by Carl. A. Belin, Jr., Paul Silberblatt was the attorney for Ronald Carns and Joseph J. Lee for Carns Brothers Inc. Following the return of the directed verdict, court was recessed until tomorrow morning . . .
