Paragraph from the 3rd Amended & Supplement Petition for Declaratory Judgement and Relief filed in the Probate Court, State of Ohio, Lake County, Docket 5, Page 544, Mar 1956:

" . . . 12.	That Mrs. E.G. Gilbert, the life beneficiary named in sub paragraph (3) of paragraph (e) of Item III of said Will, was also known as Viola M. Gilbert, is now deceased, and the defendant, John H. Watson, Jr., Trustee, has either distributed or is about to distribute 4/16ths of said trust estate to the defendants, Etta Gilbert Ellenberger and Alethea Gilbert Canary (whose correct name is Althea Gilbert Canary), adult defendants herein, who are the only children of Mrs. E.G. Gilbert; that each of said defendants, Etta Gilbert Ellenberger and Alethea Gilbert Canary (whose correct name is Althea Gilbert Canary) has attained the age of thirty (30) years; that Richard L. Canary, (whose correct name is Althea Gilbert Canary),  defendant herein; that Edward Gilbert Ellenberger and Margaret Ellenberger are the only children of Etta Gilbert Ellenberger; that Edward Gilbert Ellenberger, Margaret Ellenberger and Richard L. Canary have no lineal descendants of their own. . . ."
