        dated 17 SEP 1807; David Stockton Sen. age 60, died at his farm near
        Chillicothe on Saturday evening 12 SEP 1807. He left a widow and 9 children.
        Listed as freeman in 1777 PA; 2nd LT in 6th Co., 4th Batt, York Co., militia
        in APR 1778, commanded by Col John Andrew and Capt John Stockton his brother.

        Stockton, Sr, being of sound mind and memory tho' weak in body, recollecting
        that it is appointed unto all men once to die - do this 1th day of September,
        1807, make and ordain this my last will and testament in manner following viz:
        In the first place I commend my body to the grave to be buried in a decent and
        Christian manner in the hopes of a happy and joyful resurrection and my soul
        to God who gave it. And the worldly goods with which the Lord has blessed me I
        distribute in the following manner: 1st to my beloved wife, I will a horse and
        saddle, her choice of 2 cows, her bed and furniture, the table and chairs in
        the house, the kitchen furniture and her living off the plantation during her
        life with the free and undisturbed use of the home in which I now live. 2nd.
        to my sons, David and William, I give and bequeath a part of a tract of land
        lying in Ross Co, Duffs Fork of Deer Creek, containing 450 acres viz: to
        William I give and bequeath 1/3 part to be laid off on the upper side and to
        David I give and bequeath 1/3 part to be laid off adjoining the former as to
        include the improvement he has made, to them respectfully, and their heirs in
        fee simple forever. 3rd, to my sons Robert, Samuel and John, I give and
        bequeath the tract of land on which I now live containing 200 acres. This
        tract of land I allow to be valued at the death of my wife and the valuation
        in to 5 equal parts, two of these parts I give and bequeath to Robert,  1 1/2
        to Samuel and 1 1/2 to John, to them respectfully and to their heirs in fee
        simple forever. 4th to the heirs of my son Caleb, deceased, to my dau. Fanny
        Campbell and to my dau Polly Withrow to each of them I give one dollar. 5th to
        my son George, I give and bequeathh 1/3 part of 450 acres of land on Duffs
        Creek, which I purchased from John McDougal and to his heirs in fee simple
        forever. 6th to each of my sons, David, George, William, Robert, Samuel and
        John, I also give a horse and saddle- to the 2 stock, the horses now
        acknowledged as their property & to the others such as my estate may be able
        to afford them. To each of dau.s Peggy McDougal and Ann Creighton, I give 1
        dollars. This distribution of my estate I hereby and ordain after the payment
        of all debts and demands that may be against it -- Now that my last will and
        testament may be fuly executed according to the true intent and meankind I
        hereby nominate and appoint for executor my good and faithful friend Col.

    Madison Co., OH. She was married to James Withrow 23 APR 1798 at the
    Presbyterian Church in Mercersburg, PA by Rev. John King. James, s/o William, a
    native of England, died in AUG 1823 in Madison Co., OH (Withrow family cemetery
    later became the township cenetery) [afmr]  "Polly Withers" was mentioned in
    her father's will in 1794. The Withrows emigrated to Ross Co., OH in 1801 and
    to Walnut Run, Paint Twsp, Madison Co (then wilderness) in 1806. There they had
    a 250 acre farm. For many years, James was a major in the militia. He was
    impaneled as foreman of a grandjury on 18 NOV 1811, and was a resident
    landowner in MAR 1819. They attended the Presbyterian Church in Madison Co.,

         3 APR 1861 near Guilford, Nodaway Co., MO. Both David and Betsy were buried

         David inherited 150 acres of land on Duffs Fork of Deer Creek, Ross Co., OH,
         from his father, which he sold after he moved to Madison Co, OH, prior to
         1848.  The deed, signed by both David and his wife, was dated 5 APR 1812 and
         is recorded in Fayette Co., OH, which until 1810, was part of Ross Co. David
         moved with his wife and 4 children from Madison Co, to Missouri prior to
          1848. He served in the War of 1812 as a private in Renick's Mounted Reg.

         In Feb 1808m John and Nargaret NcDougall sold 150 acres for $234 each to
         William, David, and George Stockton, Margaret's brothers, part of a 600 acre
         parcel that was patented in 1803. (Since David Sr had purchased the land
         that he bequeather to his sons in 1807 from John McDougal, these
         transactions may have been made to clear any remaining debt. References to
         a John McDougal as a pioneer merchant and businessman, sheriff, and Ross
         county clerk for 7 years, appears frequently in the Chillicothe newspapers
         until MAY 1818, when he announced he was moving to Missouti Territory [dgo]

        named household goods to his sister Margaret, because '...her husband, John
        McDougal has eloped from his wife.'  John left his household and kitchen
        furniture under a levy by the Marshall of OH who then sold them, leaving
        Margaret and her children in need of items for her immediate care and that of
        her children.
        Her marriage, 12 NOV 1799 is the earliest documentation for any Stockton in
        Ross Co., OH
    In 1808, John McDougall and wife Margaret sold, in 3 identical $234
    transactions, 150 acres each, to William, David and George Stockton from a 600
    acres parcel patented in 1803 and adjoining David Stockton; 14 FEB 1808, Ross
    Co., OH Deed Book 8, pp152, 153 and 171.  The parcels were on both sides of
    Duff Creek to a branch of Dear Creek.

        ; he lived in Indiana during the early years of his life, and spent his time
        time hunting with the Indians. During the War of 1812 he scouted with Logan,
        the Mingo chief, whose celebrated speech is quoted in old school readers.
        The greater part of his mature years he lived at Bainbridge, OH where he died
        died 16 DEC 1865. Mrs. Stockton d. at the same place 28 JAN 1860. (errors)

        buried in Greenlawn Cemetery, Columbus, OH. George had a roving disposition
        and hunted with the indians. During the War of 1812, he hunted with Logan,

        war of 1812 as a sergeant in Capt. Brush's Co., Ohio militia

        was 21 which makes birth 1793 or before)
