Charlton Yellowley-1. He was born 1783 in Wickham, Northumberland, ENGLAND. Christening
on 05 Jan 1783 in Whickham, Durham, England. Census 1810 in Northampton Co., N. C. [1].
Deeds on 02 Jan 1814 in Book 16, p. 328 Yellowly-Bynum, Northampton Co., N. C.. He died Abt.
08 Dec 1841 in Northampton Co., NC. Administrator 1844 in Joseph G. Barkley was the
admistrator of the account of C. Yellowly.

Notes for Charlton Yellowley:

General Notes:
Charlton Yellowly was the plaintiff in a "matter of controversy" and Edward Yellowly's
administrators were the defendants in the matter in Northampton County Court dated 1826-1827.
On a paper dated 11 May 1830, Edward Yellowly's estate was said to be liable for $25.08 of costs
to the courts of Northampton County in matter that Charlton Yellowly was the complainant.

KNOW ALL MEN BY THESE PRESENTS, THAT WE, Charlton Yellowly, Samuel B. Spruill &
Joseph G. Barkley are held and firmly bound unto the State of North Carolina, in the just and full
sum of three thousand dollars current money of the said State, to be paid to the said State of
North Carolina--to which payment well and truly to be made, we bind ourselves, and every of us,
our and each of our heirs, executors and administrators, jointly and severally, firmly by these
presents. Sealed with our seals, and dates this 9th day of June A. D. 1841
WHEREAS, the above bounden Charlton Yellowly hath been this day, by the Worshipful Court of
Northamton County, appointed Guardian to Eliz. Isabela C. Yellowly & Mary G. Yellowly, Charlton
W. Yellowly & Virginia D. Yellowly children of Charlton Yellowly. Now, the condition of the above
obligation is such, that if the said Charlton Yellowley Guardian as aforesaid, shall well and truly
discharge his Guardinanship, by taking care of and improving all the estate belonging to the said
orphan; and shall also settle his Guardianship, accounts with the Court of said County, as
required by law, and that he will deliver up to the said Isabela C. Mary G. Charlton W. & Virginia
D. Yellowly children aforesaid, when they shall attain lawful age, all such estate as they ought of
right to be possessed of, or, sooner if required, agreeable to the true intent and meaning of the
Act of the General Assembly in such case made and provided, then this Obligation to be void,
otherwise to remain in full force and virtue.

On June 25, 2007, I sent a letter of request for the deeds mentioned in the "More about facts"
section. I received a reply from Velma Long, Deputy Register of Deeds for the county of
Northampton, N. C. returning my check and saying that they could not make copies for me
because the deed books do not come apart and suggested that I contact the N. C. Archives.
I can not afford to do that as the Archives charges a $20 search fee for each request. Making this
request would be about $200.00. I will have to go to the Archives and search the microfilm myself
unless I can find this at the LDS library.

COURT OF PLEAS AND QUARTER SESSIONS DECEMBER TERM 1841
To the sheriff of Northampton County Greetings
Whereas Rebecca Yellowley, widow of Charlton Yellowly dec'd having filed her petition in our said court againist Joseph G. Barkley & wife, Lavinia, Isabella Yellowley, Mary Yellowley, Charlton Yellowley & Adeline Yellowley for dower showing that her husband Charlton Yellowley died intestate .......& possessed of a tract of land in Northampton County adjoining the lands of John B. Odom & William T. Grant lying on Roanoke River & supposed to contain one hundred & seventy four acres more or less, having the defendants his only heirs at law, praying the court to order a jury ...these are therefore to command you the said sheriff to summon a good &lawful jury of free holders, to go upon the premises and after being duly qualified shall proceed together with the county surveyor to allot & set apart to the petitioner Rebecca Yellowley her lawful dower out of the lands of her dec'd husband Charlton Yellowley including the dwelling house & out houses according to act of ....and from under their hands, shall report their proceedings to the next term of this court, witness, William Bottom, clerk of our said court at office the first Monday of December, 1841.

Persuant to the annexed order we James Edwards, William D. Lassiter, Dorsey Boon, Richard Grant, Samuel Barnes, Jacob Rea, John Boon, James Wheeler, Bryant Peele, David Langford, Josiah Spivey and Stephen Lassiter free holders unconnected with the parties after being by Etheldred J. Peebles, sheriff of the county aforesaid being duly sworn & required to lay off and allot to Rebecca Yellowley widow of Charlton Yellowey, dec'd one third of a tract of land which the said C. Yellowley dec'd seized & possessed of adjoining the lands of Jno. B. Odom & William P. Grant containing by actual survey one hundred & ninety three acres did lay off and allot to the said Rebecca Yellowley sixty four & one third acres including the dwelling & other out houses-the .... and courses will more fully appear by reference to the surveyor certificate & plot here to asscended-after doing which we the undersigned jurors & sheriff put the said Rebecca Yellowley in possession of the same-given under our hands and seals this 14th day of January Eighteen hundred & forty two.
